1. Introduction and Scope
This Privacy Policy outlines the practices of Emulous Media Inc. regarding the collection, use, and protection of information pertaining to the Client ("Client") in connection with the provision of The Diamond Program services. This policy should be read in conjunction with the executed Service Agreement and Terms of Service.
2. Information We Collect
We collect information necessary to execute the four Unique Mechanisms of The Diamond Program:
2.1. Contact and Identifying Information: Name, title, business address, email address, and phone number of the Client's principal and designated point of contact (Mechanism 5.1).
2.2. Business Operating Data: Financial metrics such as Estimated Monthly Ad Spend, Average Contract Value (ACV), internal sales cycle length, and target market demographics.
2.3. Proprietary Project Data: High-resolution photos, videos, and descriptions of the Client's completed remodeling projects, collected for the High-Net-Worth Client Case Study System (Mechanism 2).
2.4. Performance Data: Real-time data including Cost Per Qualified Lead (CPQL), Qualified Lead Volume (PQLs), website engagement metrics, and CRM-based lead status updates, used to validate the Zero-Waste Qualification Funnel (Mechanism 3).
2.5. Access Credentials: Access necessary for service delivery, limited to website backend, advertising platforms (Meta, Google), and CRM/lead management systems. These credentials remain the exclusive property of the Client (Mechanism 4.1).
3. How We Use the Information
We use the collected information solely for the following purposes:
3.1. Service Delivery: To launch, manage, and optimize the High-Value Client Magnet and associated advertising campaigns.
3.2. Performance Fulfillment: To track, measure, and report on the specific performance goals (e.g., PQL delivery, ACV increase) outlined in the Service Agreement.
3.3. Asset Creation: To produce Authority Assets, including The 'Branded Book' and visual case studies, as part of the Case Study System (Mechanism 2).
3.4. Marketing: With the Client's explicit written permission, we may use non-identifying project results (e.g., "Client X achieved 15% ACV increase") or approved testimonials to market The Diamond Program to other prospective clients (Mechanism 3.3 in TOS).
4. Data Sharing and Disclosure
We only share information with third parties strictly necessary to deliver the service, or as required by law:
4.1. Third-Party Platforms: Data is necessarily shared with advertising platforms (Google Ads, Meta) and the Client's CRM, solely for the purpose of running campaigns on the Client’s own accounts.
4.2. Service Providers: We may use sub-contractors (e.g., designers for Case Studies, copywriters) who are bound by strict confidentiality agreements to assist with fulfillment.
4.3. Legal Requirements: We may disclose information if required to do so by law or in response to valid requests by public authorities.
5. Data Security and Confidentiality
5.1. Confidentiality Commitment: As stipulated in the Service Agreement, both parties agree to treat all non-public information as strictly confidential.
5.2. Security Measures: The Agency implements commercially reasonable technical and organizational security measures to protect Client data from unauthorized access, disclosure, or destruction. Access to Client data is strictly limited to Agency personnel who require it for service execution.
5.3. Data Retention: We retain Client data only for as long as necessary to fulfill the services outlined in the Service Agreement, and for a reasonable period thereafter to comply with legal obligations or demonstrate compliance.
6. Client Control and Ownership
The Client retains full control and ownership of all raw data and intellectual property generated through The Diamond Program, as governed by the Internal Scaling Hand-Off (Mechanism 4) and Section 4 of the Service Agreement.
